Employee Monitoring: Where Are the Limits?

As a general rule, two things apply: without an initial suspicion, the surveillance of employees is not permissible. And: the private residence as well as the documentation of non-relevant leisure activities are off limits. On the websites of other detective agencies, you may sometimes read that surveillance of employees during their leisure time is generally not permissible. This generalized statement is, of course, nonsensical, as there are numerous offenses for which surveillance by detectives outside working hours is essential. These include, among others, suspicions of:

• unauthorized secondary employment,
• competition fraud,
• corporate espionage and
• continued wage payment fraud.

For example, if a target person who is on sick leave due to shoulder problems goes to handball training one hour after the end of their regular working hours, this is indeed relevant to the investigation.

Another aspect is the video surveillance of employees, the unlawful use of which by unscrupulous competitors led to a major scandal in the detective industry a few years ago. Permanent video surveillance may only be installed visibly and with the employees being informed (often the works council must approve), which of course completely undermines its evidentiary value, as hardly any employee will be foolish and bold enough to commit offenses despite knowing about the video surveillance.
