• Tenants who, with the assistance of a detective, are able to prove that a landlord’s stated personal use reasons are incorrect during a lease dispute can claim the detective costs back from the landlord. AG Hamburg, Case No. 38 C 110/96
• The Regional Court of Cologne also ruled that detective costs in a neighbourhood dispute (here: encroachments onto one’s property by a neighbour) are reimbursable. However, the detective costs and the agency’s invoice must be verifiable. In this case, detective costs amounting to 30,500.00 DM were recognised as reimbursable under the ZPO up to an amount of 26,285.89 DM, which are therefore to be borne by the convicted parties.
